Cooperative Bank employee terminated, JKS demands justice, cautions agitation

The Janmukti Karmachari
Sangathan (JKS) Kalimpong Sun division Committee today cautioned of an infinite
bandh if justice is not done to one of the workers. As per the incident, one
Lakshmi Prasad Mukhia, a junior officer at the Darjeeling Branch Cooperative
Bank was suspended on the grounds of irregularity on May 23, 2006. Following
the same, the Bank formed a Committee/ Board under the lead of Retd officer, JP
Yadav as per which last year, the charges was marked baseless and Mukhia was
requested on January 19, 2012 to join back to work.
Until now everything
was fine, however, after the implementation of the West Bengal Cooperative Act
& rules the Committee/ Board was dissolved resulting in the loss of power
of the special officer. The said officer had before not accepting the
verification report of the Board had dismissed it and had requested PC
Bhattacharya, an advocate of the Kolkata High Court to once again verify the
Committee’s report. The latter report by Bhattacharya proved the charges as
correct and Mukhia was terminated vide Memo no 339/2012-13/DDCCB dated
23.07.2012.
Hence, the JKS raising
their concern over the issue has totally voiced against it and has forwarded a
memorandum to the special officer of the Cooperative Bank asking, why and how
Mukhia has been dismissed by the present special officer revoking and
dishonouring the decision of the then elected Board? What the previous enquiry
conducted against the case of Mukhia was cancelled and again a 2nd
enquiry was conducted? Why was Mukhia kept under suspension for such a long
period?
Further, the memorandum
states that it is observed that the dismissal order was issued in a hasty
manner even not taking in account the consent of the Employees Union of the
Bank which has been recognized by the prevailing Acts & Rules to have the
privilege of the part of the Management of the Bank. It is found that the order
of the dismissal was issued during the Code of Conduct period of GTA election.
So far the knowledge of the Sangathan is concerned no major decisions from any
authority could be implemented during the time imposition of Code of Conduct by
the Govt. But why Mukhia was dismissed within a period of Code of Conduct?
questions the memorandum.
Therefore, the JKS
saying that the dismissal order of Mukhia could not be accepted at all has
requested the concerned authority to revoke the dismissal order and re-instate
Mukhia in the normal service of the bank taking into the humanitarian approach
of the fact that Mukhia is retiring from September 01, 2012. However, if the
concerned authority does not consider the request of the JKS, then they have
cautioned of agitational activities taking all of its affiliated units
together.
