Oppositions challenges the Constitutional legality of GTA in Kolkata High Court “We hope GTA election will be withheld” Khati

The
Akhil Bharitya Gorkha Parisangh General Secretary Pratap Khati today said that
the election in Darjeeling Hills cannot be peaceful and nonviolent stressing
the Saturday’s attack on the former Rajya Sabha MP also the CPM leader at
Kurseong. The attack on the veteran leader has proven that security of the
lives in Hills is feeble he added.
The
ABGL had burnt the GTA documents on April 21, 2010 and the upcoming election
bears no importance said Khati. The GTA is synonymous to that of the DGHC he
supposed and alleged it as the conspiracy of the State Government. The parties
who are contesting the election are those who wanted to remain under the dominance
of the West Bengal keeping aside the main demands.
“The ABGL is planned for Gorkhaland and the
parties associated with Gorkhaland Task Force too wanted Gorkhaland for which
we have boycotted the election” said Khati explaining the non-participation in
the GTA election.
Madam Tamang many times had aware the people
about the issue, but the people never supported him and even today fails to recognize
what he strive for. But on the other hand GJM President Bimal Gurung many times
had foolish the people and still they believe him thought Khati.
A
group of the GTA oppositions have filed a Writ in the Kolkata High Court
challenging the Constitutional recognisation of the GTA informed Khati. The GTA
agreement says that there will be a Panchayat Samiti and Zilla Parishad, but
the duo has framed under the 73rd Amendment of the Indian
Constitution and the GTA cannot rule the same as it does not have any
Constitutional recognisation. How an unconstitutional body can rule the Constitutional
institution questioned Khati.
He
also explained that if GTA was a self governed institution than as per the Constitution
of India there should be reservations for the SCs, STs, women, OBCs but the GTA
misses the same. The SCs and the STs altogether constitutes 34% in the Hills,
but they are not provided with the reservation alleged Khati.
Another
Writ also has been filed in the High Court concerning the expanses of the
Gorkhaland Personnel which counts around 3 crs as per the GJM Chief statement.
“We are pretty much hopeful that the election
of the unconstitutional institution will be withheld” said Khati. Questioning
the election procedure of the GTA, Khati enlighten that the election of the
Colleges in India are held under the Election Commission but till date it has
not been crystal clear in terms of the GTA which sternly indicates GTA as unconstitutional
said Khati.
